This session offers defense attorneys a concise guide to recognizing and addressing Fetal Alcohol Spectrum Disorders (FASD) in death penalty cases. Participants will learn key steps, including collecting relevant records, identifying essential witnesses, and assembling an effective multidisciplinary expert team. The presentation will highlight common co-occurring conditions that complicate diagnosis and discuss filing motions to preclude the death penalty due to FASD’s similarities with Intellectual Disability (ID). Practical advice on clearly presenting FASD evidence to juries will be provided, aiming to strengthen advocacy for clients.
